TeeHub Intellectual Property Policy

Introduction and Commitment to Intellectual Property Rights
TeeHub is dedicated to fostering a creative and respectful online community where artists, designers, and creators can share their work with confidence and security. We firmly believe in and commit to respecting and protecting the intellectual property rights of all individuals and entities. This policy outlines our approach to intellectual property rights in accordance with international laws and conventions, aiming to ensure that all content hosted on TeeHub respects the rightful owners' intellectual property rights. (the “DMCA” - which can be reviewed here).

User Responsibility
All users of TeeHub are expected to uphold the principles of respect and integrity, ensuring that the content they upload, share, or sell through our platform is their own original work or is used in a manner that does not infringe upon the intellectual property rights of others. Users should be mindful of copyright, trademark, and publicity rights laws, which vary internationally but universally require respect for the intellectual property of others. This includes understanding and adhering to the limitations of "fair use," which does not allow for the infringement of others' rights even in the guise of innovation or commentary.

Please contact TeeHub’s Legal Department via e-mail at [email protected] (preferred method of contact) for any and all Notice and Counter Notice of claims of copyright or other intellectual property infringement. TeeHub can also be contacted via mail at the following address: TeeHub Inc, 1942 Broadway St., Boulder, CO 80302, United States, Attn: Legal Department. TeeHub’s Legal Department is the designated agent to receive notifications of alleged intellectual property infringements on the Website.

Note that TeeHub will terminate rights of subscribers and account holders in appropriate circumstances if they are determined to be repeat infringers.

Procedure for Reporting Infringements
TeeHub takes alleged intellectual property infringements seriously and has established a clear procedure for reporting such instances. If you believe that your work has been copied or used in a way that constitutes infringement, please contact our Legal Department with the following information:

- A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.

- A detailed description of the copyrighted work or other intellectual property that you claim has been infringed.

- A description of where the material that you claim is infringing is located on the TeeHub platform, sufficient for us to locate the material.

- Your contact information, including address, telephone number, and email address.

- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

TeeHub's Response to Infringements
Upon receiving a properly documented infringement notice, TeeHub will act swiftly to remove or disable access to the material claimed to be infringing. We will also make reasonable efforts to notify the user who posted the alleged infringing content, providing them with the infringement notice details and an opportunity to respond.

Repeat Infringer Policy
TeeHub maintains a policy of terminating the accounts of users who are determined to be repeat infringers in appropriate circumstances. We reserve the right to terminate access for users who infringe the intellectual property rights of others repeatedly, based on the severity and nature of the infringements.

Counter-Notice Procedure
If you believe that your content has been removed or disabled by mistake or misidentification, you may send us a counter-notice containing the following information:

- Your physical or electronic signature.

- Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or access was disabled.

- A statement by you, made under penalty of perjury, that you have a good faith belief that the content was removed or disabled as a result of a mistake or misidentification of the content.

- Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your district, or if outside the United States, for any judicial district in which TeeHub may be found.

Miscellaneous Provisions
Navigating the intricacies of copyright and trademark use within your creations requires a delicate balance, particularly when considering the concept of "fair use." It's important to understand that "fair use" is a nuanced principle that often varies by country and is not synonymous with "freedom of speech." Given its complexity and the variability in legal interpretation across jurisdictions, it's always wise to consult with a legal expert before incorporating someone else's copyrighted or trademarked material into your work intended for use on TeeHub.

"Fair use" encompasses certain situations but is far from a blanket permission for all types of uses. Before assuming your work falls under this category, especially when planning to showcase it on TeeHub, seeking legal advice can help clarify your position. Despite your best intentions and your understanding of what might constitute "fair" or permissible use, TeeHub adheres strictly to its Notice and Takedown procedure in response to infringement claims. This means that your work could be subject to removal not only upon specific complaints but also if TeeHub becomes aware of potential infringement issues through other means.

By choosing to upload and display your work on TeeHub, you accept full responsibility for ensuring it does not infringe on the rights of others. This responsibility is a key aspect of the TeeHub User Agreement, which you agree to by using the website. Continual use of TeeHub signifies your ongoing acceptance of this agreement and underscores the importance of navigating copyright and trademark use with caution and legal guidance.

For further information or to submit a complaint or counter-notice, please contact TeeHub's Legal Department through the contact information provided on our website.

Thank you for your cooperation and for helping to make TeeHub a platform that respects and upholds intellectual property rights.
